Notes from meeting 8 July 2016

Emerald Village Community Centre -  Helen, Linda, Maureen, Jenny, Michael, Kay

  • Transfer of leases when business not property.  Linda sought advice from Lands Titles Registry Office Robina.  It is not necessary for JPs to view original lease documents.  Only requirement is identity confirmation and signature witness.
  • QJA Journal, monthly Newsletter and Survey results were discussed
  • Query re a person living interstate eligibility to become a Qld, JP.  Michael followed this up with the JP Branch and received a phone call and email from Brett Newsome. He indicated "The Justices of the Peace and Commissioners for Declarations Act 1991 does not require applicants seeking appointment to reside in Queensland".
  • To provide the signing team at Stocklands Burleigh with witnessing reminders the JP Branch conducted a General Witnessing workshop on 24 June 2016. Familiar ground was covered and slides will be available in due course.
  • General discussion about various warnings and need for consistency. Perhaps to be included in new JPB Manual.
  • Discussion about different experiences re Land Title transfers/mortgages ensued.
  • Michael showed us his stamp for non-JP Branch witness certificates. His article on his blog goes into more detail.
  • South Australian EPA. Jenny was requested to witness, However in SA all attorneys must accept before principal signs and this had not occurred.  Opinion was that only a SA JP could witness attorney’s signature.
